If you are reading this page

If you are a seller

From the valuation appointment onwards the file holds your name, the address of the property, your contact details, the measurements and notes taken at the visit, the photographs and drafts of the particulars, the offers received with the position of each buyer, and the correspondence between us. Because an estate agent is required to carry out customer due diligence, the file also holds the identity evidence you supply and the record of the check made against it. Particulars go to prospective buyers and to the portals you agree to; your identity records stay with the branch; once a sale is agreed the memorandum and the sale details go to your solicitor and to the buyer's side. Identity and transaction records are kept for five years from the end of the business relationship, as the money laundering regulations require, and the marketing file is kept alongside them for the same period.

If you are a buyer or an applicant

When you ask to view, the branch records your name, your telephone number and email address, the property concerned, your position — cash, mortgage in principle, a chain, a tenancy ending — and the reason you give for looking. After the appointment the notes made of your reaction are put on the seller's file, and your position and any offer are reported to the seller with them, since that is what a seller instructs the branch to do. Where an offer is agreed, your identity evidence is taken and checked, and your details pass to the seller's solicitor so that the memorandum of sale can issue. Records of an applicant who withdraws are kept for two years so that a later enquiry from you can be answered from the same file; identity records taken on an agreed purchase are kept for five years from the end of the relationship.

If you are a landlord

An instruction to let brings proof of title, the lease where the property is leasehold, the safety records held for the property, your bank and contact details, and the written terms agreed between us. The particulars drawn from that material go to applicants and to the portals you agree to, and the safety records are shown to an incoming tenant as the law requires. Where you appoint another party to run the tenancy once it begins, the tenancy file passes to that party at handover and the branch keeps its own instruction papers. Instruction records, identity evidence and the correspondence around a completed letting are kept for five years from the end of the business relationship.

If you are a tenant or an applicant for a letting

An application brings your name, contact details, employment and income as you state them, your current address and your identity documents. Those are passed to the independent referencing agency instructed for that purpose, which carries out the checks and returns a report; the report and your application go to the landlord, who decides on them. Where the landlord accepts you, your details go into the tenancy paperwork and pass with it to the party the landlord appoints to run the tenancy. Application papers are kept for one year after the decision, and identity evidence taken on a granted tenancy is kept for five years from the end of the business relationship.

If you are a leaseholder in a managed block

Where the branch acts for the company the leaseholders formed, the block file holds your name, your unit, your correspondence address, the service-charge account for your flat, the payments received against it, your queries and the answers given, and the consultation notices sent to you. The directors of your company see the account and the correspondence, since the branch acts on their instruction; the block's accountant sees the accounts for the year; a contractor attending a communal area is given the access information needed for the visit and that alone. Block records are kept for six years from the end of the service-charge year to which they belong, and the whole file is handed to your company, or to the manager it next appoints, when the branch ceases to act.
